Terms of Service

These Terms of Service (the "Terms") govern your use of the Precision Strides websites and services, including our marketing site at www.precisionstrides.com and the rider portal at portal.precisionstrides.com (together, the "Sites"), operated by Precision Strides ("Precision Strides," "we," "us") of Wellington, Florida. By accessing or using the Sites, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Sites.

1. Who may use the Sites

Our marketing site is open to the public for informational purposes. The rider portal (the "Portal") is invite-only: accounts are created by Precision Strides for riders who train at our facility and for our staff. You may not use the Portal without an account we created for you. If a rider is under 18, the account must be arranged and consented to by a parent or legal guardian, who agrees to these Terms on the rider's behalf and is responsible for the rider's use of the Portal.

2. What the Sites are

The marketing site provides information about Precision Strides and our training services. The Portal lets riders view data recorded during their simulator training sessions — scores, metrics, charts, and trainer recaps — and lets our staff manage sessions and rider accounts. The Sites are a companion to training at our facility; they are not a standalone product, and your simulator sessions themselves (booking, facility rules, assumption of risk, and any waiver you signed) are governed by the agreements you enter at the facility, not by these Terms.

3. Your account

Keep your sign-in credentials confidential and do not share your account. You are responsible for activity under your account. Tell us promptly at contact@precisionstrides.com if you believe your account has been accessed without authorization. Keep your contact details accurate so invitations, recaps, and sign-in codes reach you.

4. Acceptable use

You agree not to: (a) access or attempt to access another person's data or any non-public part of the Sites; (b) probe, scan, or test the security of the Sites or circumvent authentication; (c) use automated tools to scrape or bulk-download content; (d) interfere with the operation of the Sites; or (e) use the Sites for any unlawful purpose. We may suspend or terminate accounts that violate this section.

5. Your riding data

You retain your rights in the data recorded about your riding. You grant us a license to collect, store, process, and display that data (including the raw simulator capture files and metrics computed from them) to operate the Portal, coach you, and provide the service described in these Terms. We may also use de-identified, aggregated data — data that no longer identifies you — to improve our metrics, benchmarks, training programs, and the service. Trainer recaps and notes written by our staff are our content, shared with you through the Portal.

6. Riding metrics are informational only

Scores and metrics in the Portal are computed automatically from simulator sensor data. They are provided for educational and training-feedback purposes only. They may contain inaccuracies, and they are not medical, health, or safety advice, and not a substitute for the judgment of a qualified instructor. Horseback riding — on a simulator or a horse — carries inherent risk; always follow your instructor's guidance and your facility agreements.

7. Intellectual property

The Sites, including their software, design, logos, metrics methodology, and content we create, belong to Precision Strides or its licensors. These Terms do not grant you any rights in the Sites other than the right to use them as intended.

8. Third-party sign-in and services

You may choose to sign in with Google, Apple, or Facebook, or by text-message code. Those services are provided by third parties under their own terms, and we are not responsible for them. Message and data rates may apply to sign-in texts.

9. Termination

You may stop using the Sites at any time and may ask us to delete your account. We may suspend or terminate your access if you violate these Terms, if you are no longer a client of the facility, or if we discontinue the Sites; where practical, we will give you notice and a way to obtain a copy of your data. Sections 5–12 survive termination.

10. Disclaimers

The Sites are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Sites will be uninterrupted, error-free, or that data (including riding metrics) will be accurate or preserved without loss.

11. Limitation of liability

To the fullest extent permitted by law, Precision Strides will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or lost profits, arising out of or relating to the Sites. Our total liability for all claims relating to the Sites will not exceed the greater of $100 or the amount you paid us for Portal access (the Portal is currently provided at no separate charge) in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing in these Terms modifies any waiver or agreement you signed at the facility.

12. Governing law and disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws rules. Any dispute relating to the Sites will be resolved exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and notify account holders by email or through the Portal before the changes take effect. Continuing to use the Sites after changes take effect means you accept the updated Terms.
